‘Many’ alleged gang members deported by Trump didn’t have criminal records in the US: ICE

(WASHINGTON) — Many of the noncitizens who were deported pursuant to the Alien Enemies Act on Saturday did not have criminal records, an Immigration and Customs Enforcement official said in a sworn filing overnight.
In a sworn declaration, ICE Acting Field Office Director of Enforcement and Removal Operations Robert Cerna argued that “the lack of specific information about each individual actually highlights the risk they pose” and “demonstrates that they are terrorists with regard to whom we lack a complete profile.”
The declaration was included in the Trump administration’s recent motion to vacate Judge James Boasberg’s temporary restraining order blocking deportations pursuant to the AEA.
“While it is true that many of the [Tren de Aragua gang] members removed under the AEA do not have criminal records in the United States, that is because they have only been in the United States for a short period of time. The lack of a criminal record does not indicate they pose a limited threat,” Cerna said.
The admission that many of the men lacked criminal records – and were deported on the assumption that they might be terrorists – comes as top Trump administration officials insist that the men were violent criminals, with President Donald Trump labeling them “monsters.”
Cerna wrote that some of the men have been convicted or arrested for crimes including murder, assault, harassment, and drug offenses, writing that ICE personnel “carefully vetted each individual alien to ensure they were in fact members of TdA.”
To determine whether a noncitizen was a “member of TdA,” he said law enforcement allegedly used victim testimony, financial transactions, computer checks, and other “investigative techniques.”
“ICE did not simply rely on social media posts, photographs of the alien displaying gang-related hand gestures, or tattoos alone,” Cerna said.
According to Cerna, a review of ICE databases suggested that “numerous individuals removed” had been arrested or convicted outside of the U.S. At least five of the men were subject to INTERPOL notices for alleged crimes including rape, kidnapping, child, abduction, corruption, and possession of illegal firearms.
Cerna also noted that some of the men were arrested or encountered during federal law enforcement raids while they were in the U.S., though the declaration did not note if the men were ever charged or convicted for any crimes.
The identities and status of the deported men have not been disclosed by the Trump administration, making it unknown what portion of the over 200 noncitizens had criminal records in the U.S. or abroad.
Department of Justice lawyers said the judge’s temporary restraining orders “are an affront to the President’s broad constitutional and statutory authority to protect the United States from dangerous aliens who pose grave threats to the American people.
Judge Boasberg on Tuesday ordered the government to file under seal to the court by Wednesday at noon details regarding two aircraft that the administration did not return to the U.S. following the judge’s verbal order last week.
(WASHINGTON) — The Trump administration could be sanctioned by a federal judge later this week after lawyers with the Department of Justice advised a federal judge Tuesday evening that they will not make a top administration official available for sworn testimony.
U.S. District Judge Charles Alsup had sought to have the acting head of the Office of Personnel Management (OPM), Charles Ezell, testify on Thursday about the mass firing of probationary employees.
But the DOJ said Tuesday that they would not make Ezell available for testimony.
By making Ezell unavailable, DOJ attorneys also withdrew his sworn affidavit, a move that Judge Charles Alsup suggested would heavily increase the odds that the Trump administration loses the case, which involves the legality of firing thousands of probationary employees.
“Live testimony of Mr. Ezell is also not necessary, as a factual matter, because existing documentary evidence and briefing demonstrates that OPM is not directing agencies to terminate probationary employees,” DOJ lawyers argued.
A group of federal unions has alleged that Ezell lied in a sworn declaration that his office did not order the firing of probationary employees based on “performance or misconduct,” prompting Judge Alsup to order Ezell to testify in person and under oath in San Francisco on Thursday.
The Trump administration attempted to push back on the order — arguing in a filing Monday that the testimony raises “fundamental constitutional concerns.”
Judge Alsup late Monday denied their request to cancel the hearing.
“The problem here is that Acting Director Ezell submitted a sworn declaration in support of the defendant’s position but now refuses to appear to be cross examined or to be deposed,” Judge Alsup wrote in an order Monday night.
The plaintiffs allege that on Feb. 13, Ezell convened a phone call with the heads of federal agencies to direct them to terminate thousands of federal employees and “falsely state that the terminations are for performance reasons.”
In a sworn declaration last month, Ezell denied directing the terminations based on performance reasons, instead arguing that OPM only issued guidance to individual agencies about the need for probationary workers to “demonstrate why it is in the public interest” for the government to continue to employ them.
“OPM did not direct agencies to terminate any particular probationary employees based on performance or misconduct, and did not create a ‘mass termination program,’ as the plaintiffs in this matter described it,” Ezell wrote.
The groups challenging the firings in court say that was a lie, and Judge Alsup appeared inclined to agree during a court hearing last month.
“How could so much of the work force be amputated suddenly overnight? It’s so irregular and so widespread and so aberrant from the history of our country,” Judge Alsup said. “How could that all happen with each agency deciding on its own to do something so aberrational?”
“I don’t believe it,” said the judge. “I believe they were directed or ordered to do so by OPM in that telephone call. That’s the way the evidence points.”
The allegations about the mass firings comes as the Trump administration faces increased scrutiny about the role of the Department of Government Efficiency in reducing the size of the federal government. During a cabinet meeting last week, Trump told the heads of the federal agencies that they are in charge of making cuts to their own departments, rather than Elon Musk and DOGE.
(LOS ANGELES) — One of the strongest storms of the season slammed fire-ravaged Los Angeles with heavy rain on Thursday, sending streams of mud and debris across roadways and sweeping a fire department vehicle off a Malibu road into the ocean, authorities said.
A member of the Los Angeles Fire Department was inside the vehicle when it was swept off the road by a large debris flow and into the ocean, according to the department.
“Fortunately, the member was able to exit his vehicle and reach safety with minor injuries. He was transported to a local hospital as a precaution,” spokesperson Erik Scott said.
The atmospheric river dumped 6.34 inches of rain in Los Angeles County, prompting mudslides in the burn scar areas from last month’s devastating Palisades Fire, Los Angeles ABC station KABC reported.
Videos captured by KABC showed bulldozers pushing streams of muddy sludge out of the roads and firefighters trudging through nearly waist-deep swamps of water and mud.
The storm also brought a line of severe thunderstorms with 70 mph wind gusts to Los Angeles County, and a possible tornado hit a mobile home park near Oxnard, California, about 60 miles from LA.
LA Mayor Karen Bass said the city prepared for the storm by clearing catch basins of fire debris, offering residents over 6,500 sandbags, setting up over 7,500 feet of concrete barriers, and having systems in place to capture polluted runoff.
Sheriff’s deputies helped residents prepare with sandbags and passed out mud and debris safety tips, Los Angeles County Sheriff Robert Luna said at a news conference Wednesday. “Our homeless outreach teams … are actively notifying individuals living in flood-prone areas like the LA River, Coyote Creek and other key waterways, urging them to relocate.”
Evacuation warnings were announced for parts of fire burn zones, including areas impacted by the Palisades Fire, and an evacuation order was issued for parts of Sierra Madre affected by the Eaton Fire, according to KABC.
All Malibu schools were closed Thursday and Friday, according to the Santa Monica-Malibu Unified School District.
The sheriff urged residents to prepare in the event they needed to evacuate.
“Unfortunately, we’ve witnessed numerous, numerous instances in the past of swift-water rescues where people were caught in dangerous, fast-moving water, and obviously, we want to prevent that,” he said.
“Nothing that you have back home is worth your life. If you decide to stay in your property in an evacuated area, debris from the burn scar areas and storm may impede roads, and we may not be able to reach you,” he warned.
Before pummeling LA, the storm first hit Northern California, bringing rain and flash flooding to the San Francisco Bay area.
Further north, the same storm system brought whiteout conditions and car crashes to Interstate 84 in Oregon.

(WASHINGTON) — A regional American Airlines passenger jet and a Black Hawk military helicopter collided over Washington, D.C., on Wednesday night in the nation’s first major commercial airline crash since 2009.
There are confirmed fatalities from the collision, law enforcement sources familiar with the ongoing operation told ABC News. Several bodies have been pulled from the Potomac River, and so far, no survivors have been rescued, sources said.
There were 60 passengers and four crew members aboard the jet, which can hold up to 70 passengers. It departed from Wichita, Kansas, according to the FAA.
“I know that flight. I’ve flown it many times myself,” Jerry Moran, a senator from Kansas, said at a press briefing on Thursday morning.
“I lobbied American Airlines to begin having a direct, nonstop flight service to DCA,” he said of the route, which has been operating for about one year.
“It is certainly true that in Kansas and in Wichita in particular, we’re going to know people who are on this flight, know their family members, know somebody. So this is a very personal circumstance, as well as an official response,” Moran added.
Three Army soldiers were aboard the Black Hawk helicopter at the time of the crash. Army officials confirmed that no senior military leaders were onboard.
The Black Hawk helicopter was on a training flight at the time, according to Heather Chairez, spokesperson for Joint Task Force-National Capital Region.
It was based at Fort Belvoir, Virginia, according to an Army official. “We are working with local officials and will provide additional information once it becomes available,” the official said.
The collision involved American Airlines Flight 5342, the airline said. The flight was operated by PSA Airlines.
“Our concern is for the passengers and crew on board the aircraft,” the airline said. “We are in contact with authorities and assisting with emergency response efforts.”
The Federal Aviation Administration said preliminary information indicates that a PSA Airlines Bombardier CRJ700 regional jet collided in midair with a Sikorsky H-60 helicopter while on approach to the airport.
A multi-agency search-and-rescue operation is underway, authorities said. About 300 responders were on the scene as of late Wednesday night, according to D.C. Fire and EMS Chief John Donnelly.
The operation will continue overnight as divers and boats are searching the dark, frigid waters of the Potomac River.
Officials have not provided an update on whether anyone had been pulled from the water or taken to the hospital but three emergency care providers in the Washington, D.C. region have confirmed with ABC News that they have not yet received any patients from the crash.
“At this time, we have not received any patients,” VHC Health, formerly the Virginia Hospital Center, said in a statement at midnight on Wednesday. “The crash at Ronald Reagan Washington National Airport is a sad and shocking tragedy and our thoughts are with all those impacted by this incident. We are working directly with the Arlington and Metropolitan Police Department, Fire, and EMS teams and all authorities,” VHC Health said, adding, “VHC Health is prepared to assist and support first responders as these agencies continue their emergency response.”
The water temperature in the Potomac River is approximately 36 degrees, and the air temperature at the time of the crash was 50 degrees with winds gusting 25 to 30 mph.
This is the first major commercial airplane crash in the United States since the Colgan Air crash near Buffalo, New York, in 2009.
President Donald Trump released a statement following the crash Wednesday night.
“I have been fully briefed on the terrible accident which just took place at Reagan National Airport. May God Bless their souls. Thank you for the incredible work being done by our first responders. I am monitoring the situation and will provide more details as they arise,” he wrote.
The president followed up with a post on Truth Social that seemed to be probing for further answers regarding the cause of the crash.
“Why didn’t the control tower tell the helicopter what to do instead of asking if they saw the plane,” he wrote in the post, adding, “This is a bad situation that looks like it should have been prevented. NOT GOOD!!!”
Defense Secretary Pete Hegseth said the Army and Defense Department would “immediately” launch an investigation into the collision.
“Absolutely tragic. Search and rescue efforts still ongoing. Prayers for all impacted souls, and their families. Investigation launched immediately by Army & DoD,” Hegseth wrote on X.
Virginia Gov. Glenn Youngkin said “extensive resources are fully supporting the search and rescue efforts” following the crash.
“First responders from across Northern Virginia, DC and Maryland mobilized quickly,” he said on X. “I ask everyone to pray for the passengers, crews, their families, and brave first responders.”
Wichita Mayor Lily Wu discussed the reality of people from her community being on the flight — noting that the first direct flight from Wichita to the nation’s capital, which began daily service on Jan. 8, 2024, coincided with her first day in office.
“Our entire community right now is praying, hoping for better news,” Wu told ABC News. “But as a community, the entire city of Wichita, the city council members and the staff all throughout the city of Wichita are hoping that we have better news to come out of this.”
Meanwhile, in somber remarks at a news conference early Thursday morning, Kansas Sen. Roger Marshall suggested he feared the passengers and crew aboard a regional American Airlines jet and a Black Hawk helicopter that collided were lost.
“When one person dies, it’s a tragedy,” Marshall said. “But when many, many, many people die, it’s an unbearable sorrow … It’s really hard when you lose, you know, probably over 60 Kansans, simultaneously.”
Speaking of the pilots, flight attendants and military personnel, Marshall added, “All those lives are so valuable, and it is such a tragedy that we lost them.”
Officials have not publicly confirmed any fatalities.
However, U.S. Figure Skating issued a statement saying that “several members of our skating community were sadly aboard American Airlines Flight 5342,” according to the statement obtained by ABC News.
“U.S. Figure Skating can confirm that several members of our skating community were sadly aboard American Airlines Flight 5342, which collided with a helicopter yesterday evening in Washington, D.C. These athletes, coaches, and family members were returning home from the National Development Camp held in conjunction with the U.S. Figure Skating Championships in Wichita, Kansas,” the statement said. “We are devastated by this unspeakable tragedy and hold the victims’ families closely in our hearts. We will continue to monitor the situation and will release more information as it becomes available.”
Russian media also reported that two Russian figure skaters were on board the plane and expressed condolences to the families and friends of those killed in the plane crash.
“Unfortunately, we see that these sad information is being confirmed,” Russian presidential spokesman Dmitry Peskov said on Thursday morning. “There were other of our fellow citizens there. Bad news from Washington today.”
Earlier, several Russian state media outlets were reporting that Russian world figure skating champions in pairs (1994) Evgenia Shishkova and Vadim Naumov were on board the plane, though U.S. authorities have not confirmed these reports.
At least 19 aircraft that were in the air and due to land at Reagan National Airport had to be diverted after the mid-air collision, according to Jack Potter, president and CEO of the Metropolitan Washington Airports Authority. The diverted flights landed at Dulles International Airport in Virginia.
The National Transportation Safety Board is leading the investigation and the FBI Washington Field Office said in a statement that it’s sending its National Capital Response Squad “in support of our law enforcement and public safety partners.”
