Judge in Uvalde criminal case denies motion to dismiss charges, sets tentative trial date
A judge has denied a motion to dismiss charges in the Uvalde, Texas, criminal case stemming from the 2022 mass shooting and has set a tentative trial date.
Former Uvalde school district police chief Pete Arredondo, who was the on-site commander at Robb Elementary School on the day of the shooting, and former school officer Adrian Gonzales appeared in court for a joint pretrial hearing on Thursday.
Arredondo faces 10 counts of child endangerment and abandonment on behalf of the injured and surviving children in classroom 112. Gonzales faces 29 counts: 10 counts for each surviving child and 19 for each deceased child. Arredondo and Gonzales have both pleaded not guilty.
Their charges stem from the May 24, 2022, mass shooting during which a gunman killed two teachers and 19 students at the elementary school. Law enforcement waited some 77 minutes at the scene before breaching a classroom and killing the gunman.
The judge on Thursday denied the motion to quash Arredondo’s indictment. The judge also set a tentative trial start date for October 2025.
Arredondo had filed a motion asking the court to declare his child endangerment indictment invalid, arguing the gunman was solely responsible for the shooting.
Arredondo has repeatedly defended his actions and told investigators he did not believe the gunman was an active shooter when he arrived. He also has insisted he was not in command of the police response.
The indictment alleges that despite having time to respond to the shooting, Gonzales failed to act to impede the gunman and failed to follow active shooter training by not advancing toward the gunfire.
Gonzales’ defense attorney, Nico LaHood, has said, “There was over 370 officers there. We have not seen or even heard of a theory of why Mr. Gonzales is being singled out.”
Families of victims and survivors who were in the courtroom Thursday said they were relieved the case is moving forward.
“It was hard being inside the courtroom while Pete was with his attorneys as we listened to their arguments about why he felt he wasn’t responsible for Jackie’s death,” said Gloria Cazares, whose 9-year-old daughter, Jackie, was killed. “After two and half years, it finally feels like things are progressing.”
During the hearing, attorneys discussed their frustration with their inability to receive an unredacted copy of a U.S. Customs and Border Protection report about the agency’s response to the Robb Elementary shooting.
To date, Arredondo and Gonzales are the only indicted law enforcement officers of the 376 officers who were among the police response to the shooting.
(SANTA CRUZ, Calif.) — A powerful storm pummeling the West Coast churned up waves as high as 60 feet, killing one man, sweeping another out to sea and prompting multiple rescues when a pier collapsed in Santa Cruz, California, authorities said.
A series of storms leading into Christmas are expected to continue to pound the West Coast on Tuesday with heavy rain, gusty winds and giant ocean waves.
On Monday, the wild weather turned deadly in Santa Cruz when a large wave hit a man, trapping him beneath debris at a beach, according to the Santa Cruz County Sheriff’s Office.
The death unfolded around 11:30 a.m. local time at Sunset State Beach in Santa Cruz, about 75 miles south of San Francisco. First responders managed to pull the man from the water, but he was later pronounced dead at a hospital, the sheriff’s office said. The man’s name was not immediately released.
The storm also caused the Santa Cruz Municipal Wharf pier to partially collapse, according to the sheriff’s office. Three men, all members of a city crew working on the pier at the time, were thrown into the ocean, according to the sheriff’s office.
Lifeguards sprang into action and rescued two of the men, while the third worker swam to shore on his own. None of the men were seriously injured, according to Santa Cruz Mayor Fred Keeley.
The incident lopped off a 150-foot section at the end of the pier, which was undergoing a $4 million restoration. Large chunks of the pier were left floating in the water.
Video showed one worker stranded on a piece of the pier floating in the water being rescued by a first responder on a jet ski.
The sheriff’s office also issued an evacuation order Monday afternoon for oceanfront residents along an approximately 3-mile stretch of shoreline just south of Santa Cruz, citing large swells and high tides.
The National Weather Service in the Bay Area warned that “dangerous and life-threatening beach conditions” are forecast for along the Pacific Coast through Tuesday, including rough seas and breaking waves up to 60 feet.
A separate rescue attempt occurred Monday near Monterey, where authorities believe high surf likely pulled a man into the ocean. The incident happened at Marina State Beach along the Monterey Bay around noon, according to the Marina Police Department.
“Bystanders attempted to assist the individual; however, due to extremely large waves and strong currents, their rescue efforts were unsuccessful,” police said in a statement.
Marina police officers, firefighters, U.S. Coast Guard and the California Highway Patrol launched an extensive search for the man using boats and aircraft, but were forced to suspend the rescue operation when weather conditions became too dangerous, police said. The man, who was not immediately identified, remained missing Tuesday morning.
At the time of the search, the National Weather Service estimated waves in the Santa Cruz area to be 25 to 50 feet, according to police.
High surf warnings were issued up and down the West Coast from Washington to Southern California.
The Santa Cruz Sheriff’s office said first responders also made water rescues in a harbor near Capitola, about 4 miles south of Santa Cruz.

(NEW ORLEANS) — President Joe Biden and first lady Jill Biden will head to New Orleans on Monday to meet with the families and community members impacted by the devastating truck attack that killed 14 and injured dozens, the White House said.
The suspect, Shamsud-Din Jabbar, drove a pickup truck onto a sidewalk and around a parked police car serving as a barricade to plow into pedestrians over a three-block stretch on Bourbon Street early on New Year’s Day, police said.
Jabbar then exited the damaged vehicle armed with an assault rifle and opened fire on police officers, law enforcement said. Officers returned fire, killing Jabbar. At least two officers were injured, authorities said.
FBI Deputy Assistant Director Christopher Raia called the attack a premeditated “act of terrorism” but said there was no additional threat to the public.
The FBI and Department of Homeland Security has issued a joint intelligence bulletin warning the nation’s 18,000 law-enforcement agencies about potential copycats, ABC News learned. The bulletin was sent out of an abundance of caution to sensitize law enforcement around the country to be on the lookout for any activity pointing to the use of vehicles as a method to inflict mass casualties, sources told ABC News.
“We advise federal, state, local, tribal, and territorial government and law enforcement officials and private sector security partners to remain vigilant of potential copycat or retaliatory attacks inspired by this attack and other recent, lethal vehicle-ramming incidents across the globe,” the bulletin said.
The bulletin notes that ISIS has been promoting the use of vehicles as a terrorism weapon since around 2014.
Sources told ABC News that ISIS has ramped up calls for its supporters to launch low-tech, mass casualty ramming attacks in recent months, especially since the most recent Israel-Hamas conflict began in October 2023.
Jabbar, a 42-year-old Army veteran and U.S.-born citizen from Texas, drove from Houston to New Orleans on Tuesday evening and posted several videos online “proclaiming his support for ISIS,” and mentioning he joined ISIS before this summer, Raia said.
The bulletin stated that Jabbar was inspired by ISIS but that there remains no evidence of any co-conspirators. A senior law-enforcement official told ABC News that there is so far no sign of ISIS claiming responsibility for the New Orleans attack.
“Law enforcement should be aware that in many cases attackers have conducted vehicle-ramming attacks with secondary weapons and may continue the attack with edged weapons, firearms, or IEDs after the vehicle has stopped,” the bulletin said. The tactic could be “attractive” for foreign terrorist organizations and other actors due to its low complexity threshold, the warning said.
An intelligence bulletin from the New York Police Department obtained by ABC News indicated that ISIS supporters did celebrate the attack online. Violent extremists, the bulletin said, “continue to view densely populated walkways, parades, mass gatherings and other outdoor events along streets, especially during holidays, as vulnerable targets of opportunity.”
“This enduring threat underscores the criticality of pre-staged blocker cars and the deployment of other effectively configured countermeasures including heavy block, barriers and bollards,” it added.
Surveillance footage showed Jabbar placing two improvised explosive devices in coolers in the Bourbon Street area, Raia said. He had a remote detonator in the truck to set off the two devices, Biden said. Both devices were rendered safe, officials said.
Bomb-making materials have been recovered at Jabbar’s Houston home, sources confirmed to ABC News. The items found were also referred to as “precursor chemicals” by agents in the field, sources said.
Law enforcement cleared and reopened Bourbon Street on Thursday as the investigation continued. New Orleans Mayor LaToya Cantrell said authorities had the “confidence” to reopen the area to the public ahead of the Sugar Bowl Thursday afternoon, which was initially scheduled for Wednesday but postponed in the wake of the attack.
“I want to reassure the public that the city of New Orleans is not only ready for game day today, but we’re ready to continue to host large-scale events in our city,” she said. “Our hearts and prayers continue to go out to the victims’ families,” Cantrell added.
There is no apparent direct connection between the New Orleans attack and Wednesday’s Tesla Cybertruck explosion outside the Trump International Hotel Las Vegas, which is also being investigated as a possible act of terror, Raia from the FBI said Thursday.
(SHILOH, Ala.) — At a recent church service in Cleveland, a group of visitors from a rural Alabama community nearly 900 miles away, including pastor and business owner Timothy Williams, joined congregants in singing the spiritual “I Don’t Mind Waiting.”
Williams has grown used to waiting.
After six years of frequent flooding, two presidential administrations and numerous reassurances from top officials, homeowners like Williams who live in the majority-Black Shiloh community say they are still waiting for state and federal agencies to make them whole.
Now, with the Biden administration ending Monday, they feel they are running out of time.
“The longer they put us on hold, things are getting worse and worse,” said Williams, who has been advocating for Shiloh since 2018, after community members say a project by the Alabama Department of Transportation (ALDOT) to widen an adjacent highway led to flooding on their properties.
When the state denied responsibility for the flooding, community leaders turned to the federal government for help. In September 2022, the U.S. Department of Transportation’s Federal Highway Administration opened an investigation into their concerns.
The administration says it aims to complete investigations within six months, but after a year with no resolution, Shiloh residents focused their efforts on reaching the top transportation official in America: U.S. Transportation Secretary Pete Buttigieg.
Shiloh residents became hopeful last spring when Buttigieg traveled to their community to see how runoff from the expanded highway drained onto their properties. He toured the historic community, listening to residents and telling them Washington would make things right.
The people of Shiloh say they were optimistic about what was to come, but when the federal investigation came to a close in October — more than two years after it began — the resulting Voluntary Resolution Agreement with ALDOT fell short of their expectations.
The deal required the state to mitigate future flooding in Shiloh, but it did not address existing property damage. It also did not assign blame for the flooding, raising questions as to whether any government entity is liable for compensating the residents for their losses.
“We are closely coordinating with the Federal Highway Administration on our efforts to follow through with the terms of the Voluntary Resolution Agreement,” ALDOT spokesperson Tony Harris told ABC News.
On the brink of yet another administration change, Williams wants Buttigieg to commit more resources to Shiloh in his final days in office.
“We want him to give us a binding written agreement that will cover the damages of the people’s homes and their properties and make the people whole,” Williams said. “That’s all we’re asking him to do and he can do that.”
A spokesperson for the U.S. Department of Transportation, however, said the secretary cannot meet this demand.
“Congress has not authorized any programs or funding for DOT that can provide emergency relief directly to communities experiencing hardship, so this whole-of-government approach is critical to help the Shiloh community access federal assistance that is not available through DOT alone,” the spokesperson told ABC News.
The flooding in Shiloh has consequences ranging from transportation to housing to environment, spanning the jurisdictions of a web of federal agencies. Some of these departments are involved in a task force led by the U.S. Transportation Department to identify resources available for Shiloh, an Environmental Protection Agency spokesperson told ABC News.
“EPA shared all funding opportunities and technical assistance available to the community,” the spokesperson wrote, adding that Shiloh community members applied for an EPA grant program in November.
Since the Voluntary Resolution Agreement did not assign liability for the flooding – the responsibility for finding government funds to fix the flood damage has largely fallen to the Shiloh community members. They now say they’ve been wading through red tape while their homes fill with water.
With the clock ticking toward another Trump administration, Shiloh community leaders are worried they’ll be left behind. They aren’t waiting for federal agencies to come to them anymore.
In December, Williams and his daughters traveled from Alabama to Ohio, where Buttigieg was scheduled to speak before the City Club of Cleveland.
In his address, Buttigieg discussed the accomplishments of his administration, including tackling infrastructure inequities in vulnerable communities.
“Many communities had transportation projects done to them rather than with them, often because they lacked the wealth or political power to resist or reshape them,” Buttigieg said.
Listening closely alongside the Williams family were some of their supporters: Shiloh-area native Dr. Robert Bullard, known as the “father of environmental justice” for his pioneering research, and representatives from the Sierra Club.
“The point of transportation is to connect, and yet there were so many places where transportation functioned to divide, sometimes contributing to racial and economic divisions,” Buttigieg told the audience. “We can do something about it, and we are.” In the case of Shiloh, however, what exactly can be done and who should do it remains unclear. All the while, the flooding continues.
When asked by ABC News if he would meet with the Shiloh families who’d come to Cleveland, Buttigieg said he “would want to take that up directly with them.”
“We’ll continue to do everything we can, both within and beyond any kind of formal and official steps, to try to support that community because I’ll never forget what they’re going through,” Buttigieg said.
After they were denied another meeting with the secretary, Williams and Bullard put together a petition with roughly 5,000 signatures demanding a binding agreement to cover damage to residents’ properties.
On Tuesday, the group traveled another 900 miles, heading to Washington to deliver their petition directly to the U.S. Transportation Department before Buttigieg’s term ends.
“We want to see a victory,” Bullard said. “How this community overcame all odds and got the resources from the federal government to make them whole.”
Sierra Club Executive Director Ben Jealous joined the group to call for justice in Shiloh.
“Their community’s been turned into a drainage ditch by the Alabama Department of Transportation with U.S. Department of Transportation dollars,” Jealous said.
After relentless flooding and tireless advocacy, Shiloh’s 150-year legacy still hangs in the balance. While Washington politics churn on, their homes continue to sink and runoff drowns their generational wealth. Bullard stressed that there is still time for Washington to act.
“It’s already been two administrations that have allowed this to happen,” Bullard said. “This should not — and must not — bleed into a third administration.”
